Flying the American flag upside down is a violation of Title 4, Chapter 1 of the United States Code. It’s also a virulent form of domestic terrorism, experts say.
Democrats and journalists trembled with rage in 2024 when the New York Times unearthed a photo (taken three years earlier) of an upside-down American flag flying outside the home of Supreme Court Justice Samuel Alito, who said the flag was briefly inverted by his wife in response to a dispute with a neighbor.
“Turning the American flag upside down is a symbol of emergency and distress, first used as a military S.O.S.,” New York Times reporter Jodi Kantor wrote. “In recent decades, it has increasingly been used as a political protest symbol — a controversial one, because the flag code and military tradition require the paramount symbol of the United States to be treated with respect.” CNN’s Brian Stelter called it a “jaw-dropping story.” MSNBC’s Joe Scarborough said it was “just disgusting.” Alito was ridiculed as an “insurrectionist.” Many liberals insisted that his refusal to denounce his wife and disavow the inverted flag was a sign that our cherished democracy was on the brink of collapse.
They were right.
Inverting the flag in protest is an unconscionable violation of Title 4, Chapter 1 of the United States Code, colloquially known as the U.S. Flag Code, which outlines the proper etiquette for displaying the Stars and Stripes. Therefore, it is an assault on the United States Constitution and everything our Founding Fathers fought to achieve. It is no less than treasonous desecration of American values, the moral equivalent of strangling a bald eagle, sucker-punching a baby, or pissing on a soldier’s grave. Anyone who does it—at any time, for any reason—is fomenting violent insurrection against the government, declaring war on the United States, and pledging allegiance to every single one of America’s enemies, especially the Nazis. It is literally worse than genocide.
That is why every single Democratic politician (and Democratic journalist, pardon the redundancy) must immediately denounce the anti-American insurgents who took part in the “No Kings” riots over the weekend as pro-American patriots were celebrating the Army’s birthday. Inverted flags were spotted at nearly every so-called protest around the country. Given that none of the perpetrators appear to have been denounced or disavowed by their fellow rioters, it stands to reason that all of the roughly 5 million individuals alleged to have participated in the “No Kings” insurrection are guilty of betraying their country, desecrating the Constitution, and subverting the foundation of our democracy.
